The central issues were i) the meaning and purpose of reg. 30(6), Public Contracts (Scotland) Regulations 2006 that allows a contracting authority to reject a tender on the ground that it is abnormally low, and; ii) an application made by the Scottish Ministers under reg. 47(10) for an interim order to end the prohibition against their entering into contracts for the provision of services in relation to trunk roads in Scotland. Amey, the pursuer, was unsuccessful in a bid for contracts providing for management, maintenance and improvement works in trunk roads within the south west and north west of Scotland respectively.
