On October 15, 2010, Congress amended the Seaman’s Protection Act by enacting Section 611 of the Coast Guard Authorization Act of 2010. Among the revisions, Congress transferred the administration of the whistleblower protections in the Act to OSHA, which were previously enforced through federal court. Congress also expanded protected activities under the Act, and adopted the procedures and burdens of proof provided in Section 31105 of the Surface Transportation Assistance Act.

Edward Bylsma, a Clark County deputy sheriff, drove his marked police car through a Burger King drive-through and had an uneasy feeling after he received his burger.
He stopped in a parking lot to remove the top bun and found that someone had spat on his meat patty. DNA testing later confirmed that the saliva matched that of one of the Burger King employees.
Bylsma sued Burger King in federal court for negligence, product liability and vicarious liability. He claimed that the incident caused him sleeplessness, vomiting and food aversion.

A worker was killed on Monday morning in an industrial accident at a Hempfield Township manufacturing plant.
State police in Greensburg identified the worker as Richard J. Licina Jr., 60, of Wilmerding.
Trooper James Simpson reported the accident occurred before 9:30 a.m. at Plum Corp., which produces industrial and commercial siding products. Plum Corp. is located in the Greensburg-Hempfield Business Park on Woodward Drive Extension.
Licina, who had worked at the company for 30 years, was moving a large steel coil using a 15-ton overhead crane, Simpson said.

The County Court last month heard that Rahman Memishi suffered post-traumatic stress disorder and depression after Stephen Peluso, 38, was killed in April 2005.
Mr Memishi was driving a forklift loaded with two pallets of butter at the Hume Road factory when Mr Peluso walked in front of it.

One of Britain’s biggest supermarkets yesterday pulled all its own brand frozen beefburgers from sale after “exceptionally high” levels of horse meat were found at its Northern Irish supplier.
Asda withdrew the beefburgers as a "precautionary measure" after tests at Freeza Meats in Newry County Down, found beef stored at its plant contained up to 80 per cent horse meat.
Labour will today demand to know whether schoolchildren and hospital patients could have been unwittingly fed beef contaminated with horsemeat.
Until March last year Freeza Meats supplied Sodexo, a company which provides catering for schools, care homes and hospitals.
Mary Creagh, the shadow environment secretary, will write to the environment secretary to say that the Food Standards Agency should carry out tests on all products supplied by Freeza Meats.
She criticised the Food Standards Agency for failing to conduct DNA tests on the meat when they seized it in September last year.

HARBIN - Three workers have been pulled to safety and another three remain trapped after a coal mine accident killed seven in Northeast China's Heilongjiang province, authorities said Wednesday.
The three were lifted out of the mine at around 11 a.m. Wednesday and were in stable condition, according to the Dongning County government.
Three workers entered the Yongsheng colliery to pump out water, but poisonous gas caused them to faint around 10:30 a.m. Tuesday.

Court fines EasyJet €70,000 over disabled passengers - France
The airline was initially convicted of discrimination back in January 2012 but appealed against the ruling.
On Tuesday that appeal was thrown out with the court also ordering the airline to pay €2,000 compensation to each of the three victims and a symbolic sum of €1 to a French disabled charity.

A woman who believes her cancer was caused by asbestos exposure as a child during demolition operations near her school, is taking legal action.
Penny Garner, 45, from Salford, has the lung condition mesothelioma, which is linked to asbestos dust.
Her lawyer believes she was exposed at Seedley Primary School in the 1970s, as a nearby swimming pool was demolished.
Demolition firm P McGuinness and Co denies liability and Salford Council has not commented on the case.
Ms Garner, from Peel Green, was diagnosed with the terminal condition in 2011 and says she could not believe it when the consultant asked if she had worked with asbestos.

London Fire Brigade said a gas explosion was believed to have occurred at Pier House in Oakley Street, Chelsea, at about 16:20 GMT.

Unions urge crackdown to attacks on North East public sector workers - Today's News -
Data obtained under the Freedom of Information Act has shown there were 7,135 reported attacks on council and National Health Service workers between 2010 and 2012.
Out of these incidents 6,285 were physical attacks and 850 were verbal assaults. Only 159 were reported to police, but 53 were deemed so serious that they were referred to the Health and Safety Executive.
Those who reported attacks included teachers, classroom assistants, care workers, catering staff, NHS employees and social workers.

The Art and Creative Materials Institute, a trade association which tests the safety of crayons on behalf of the makers, initially insisted the test results must be incorrect, although they later said they do not test for asbestos.[98] In May 2000, Crayola said tests by a materials analyst, Richard Lee, whose testimony has been accepted in lawsuits over 250 times on behalf of the asbestos industry, showed two of its crayons were negative for asbestos.[99] In June 2000, Binney & Smith, the maker of Crayola, and the other makers agreed to stop using talc in their products, and changed their product formulations in the United States.[99] The mining company, R T Vanderbilt Co of Gouverneur, New York, which supplied the talc to the crayon makers, insists there is no asbestos in its talc "to the best of our knowledge and belief",[100] but a news article claimed that the United States Mine Safety and Health Administration (MSHA) did find asbestos in four talc samples that it tested in 2000.[98] At the time, however, the Assistant Secretary for Mine Safety and Health informed the news reporter that his article was in error and that the reporter had misquoted him stating that “In fact, the abbreviation ND (non detect) in the laboratory report – indicates no asbestos fibers actually were found in the samples.”[101] Further supporting the claim of Vanderbilt that asbestos is not found in this industrial grade talc (composed of a very complex mineral mixture) is a decades old record of analytical work that does not find asbestos in this talc by mineral scientists in academia, government and contract laboratories.[102][103][104][105][106][107][108][109][110]Human, animal and cell health studies conducted on Vanderbilt’s controversial talc also lend no support for the presence of asbestos in this talc.[111][112][113] Several non fully peer-reviewed health reports concerning Vanderbilt talc do exist and suggest a "same as" asbestos risk, some of which were referenced in the previously cited news articles.[114][115]

The use of asbestos in new construction projects has been banned for health and safety reasons in many developed countries or regions, including the European Union, Australia, Hong Kong, Japan, and New Zealand. A notable exception is the United States, where asbestos continues to be used in construction such as cement asbestos pipes. The 5th Circuit Court prevented the EPA from banning asbestos in 1991 because although EPA research showed it would cost between $450 and 800 million and save around 200 lives in a 13-year length, the EPA did not provide adequate evidence for the safety of alternative products.[116] Until the mid-1980s, small amounts of white asbestos were used in the manufacture of Artex, a decorative stipple finish,[117] however, some of the lesser-known suppliers of Artex were still adding white asbestos until 1999.[118] Removing or disturbing Artex is not recommended, as it may contain white asbestos.
Prior to the ban, asbestos was widely used in the construction industry in thousands of materials, some are judged to be more dangerous than others due to the amount of asbestos and a materials friable nature. Sprayed coatings, pipe insulation and Asbestos Insulating Board (AIB) are thought to be the most dangerous due to their high content of asbestos and friable nature. Many older buildings built before the late 1990s contain asbestos. In the United States, there is a minimum standard for asbestos surveys as described by ASTM Standard E 2356-04. The U.S. Environmental Protection Agency includes some but not all asbestos-contaminated facilities on the Superfund National Priorities list (NPL). Renovation and demolition of asbestos contaminated buildings is subject to EPA NESHAP and OSHA Regulations. Asbestos is not a material covered under CERCLA's innocent purchaser defense. In the UK, the removal and disposal of asbestos and of substances containing it are covered by the Control of Asbestos Regulations 2006.[119]
In older buildings (e.g. those built prior to 1999 in the UK, before white asbestos was finally banned), asbestos may still be present in some areas e.g. old bath panels, concrete water tanks and many other places. Removal of asbestos building components can also remove the fire protection they provide, therefore fire protection substitutes are required for proper fire protection that the asbestos originally provided

Wind turbines 'safe' despite collapses, says industry
Wind turbines are safe despite two of them collapsing in the South West in the space of a week, a representative of the industry has insisted.
The first turbine fell at Bradworthy in Devon last Sunday and the second near Launceston in Cornwall on Wednesday.
Some local residents said they feared someone being killed and said plans for new turbines should be stalled until an inquiry had been completed.
Renewable UK, which represents the industry, said that was "premature".

WASHINGTON – Faced with substantial industry opposition, federal regulators are struggling to implement a sweeping aviation safety law enacted after the last fatal U.S. airline crash nearly four years ago, according to a report by a government watchdog.
The Federal Aviation Administration is experiencing lengthy delays in putting in place rules required by the law to increase the amount of experience necessary to be an airline pilot, provide more realistic pilot training and create a program where experienced captains mentor less experienced first officers, according to the report by the Department of Transportation's Inspector General. The report was obtained by The Associated Press.

Fire officials said fire from a barbecue pit is to blame after a fireworks warehouse burst into flames Saturday afternoon.
It happened at American Chinese Fireworks on Highway 181, just outside of Floresville.

Island Steel Erectors has been ordered to pay an $85,000 fine for a workplace accident that caused the death of a Milton man.
David Hughes, 63, was struck by a 2,000-pound load of steel that was on a flatbed truck he had driven to a job site at 430 Wyecroft Rd. in Oakville on Dec. 21, 2010.
After an investigation by the provincial Ministry of Labour, Island Steel Erectors was charged under Ontario’s Occupational Health and Safety Act.
At a court hearing in Milton this morning, the company, represented by Lance Arsenault, pleaded guilty to one count of failing to ensure a safe workplace.

ILLEGAL horsemeat contaminated with a cancer-causing drug was butchered in a British abattoir and sent to a farm in Yorkshire for human consumption, a Government agency has confirmed.
Health Ministers revealed yesterday that, contrary to previous assurances, a horse which was killed and butchered in Britain and known to be contaminated with the carcinogenic drug phenylbutazone – widely referred to as “bute” – has indeed entered the UK food chain.
Food safety officials claimed the banned meat was eaten only by the horse’s original owner, a farmer in Kirklees, and an associate of his on another farm in Lancashire.
But Labour warned there was no real evidence the potentially dangerous meat had not been distributed more widely. Bute is given to horses as an anti-inflammatory, but can cause cancer in humans and is strictly banned from entering the food chain across the EU.

Meadowhall worker suffered electric shock at work - - The Star
A WOMAN has won a payout after suffering an electric shock from a faulty freezer at work in Meadowhall.
Julie Humphries, from Rotherham, has been awarded compensation for the injuries she sustained while working behind the counter at Boost Juice Bar in Meadowhall in February 2009.
The 34-year-old received the shock after placing her hand on top of a freezer while collecting produce.
The incident caused Mrs Humphries, who lives in Rotherham, severe pain in her neck and shoulders as well as agonising headaches.
She had to take a week off work following the accident and continues to get bouts of pain, which can also force her to take further time off.
Investigations carried out by Thompsons Solicitors found the branch manager knew there was a fault with the freezer but failed to switch it off or inform staff of potential danger.
The manager lost his job because of the health and safety blunder.
Boost Juice Bars Ltd – a chain which has stores across the UK – admitted liability and settled the claim out of court.

Marrero woman sues over construction job site accident | Louisiana Record
Patrica Terrebonne filed suit against Clark Construction Group LLC, Boh Brothers Construction Company, McCarthy Building Companies Inc. and Clark/McCarthy Healthcare Partners in the Orleans Parish Civil District Court on Nov. 15.
Terrebonne was employed as a pile logger on the Veterans Administration Hospital job site in May 2012, the suit claims. On May 7, she tripped on debris, injuring her right knee.

A LURGAN woman has told how she was lucky to dodge flying debris as she walked past the ongoing roadworks in Lurgan.
The woman was coming up Edward Street on foot when she encountered the roadworks. She said: “As I was walking past this guy was working away with a Kango hammer. A piece of rock shot out right in front of my leg. I was lucky to avoid it.
“It was very dangerous. Imagine if I’d have been a mother wheeling a pram or walking their child and that bit of rock had hit their child. It could have done some serious damage.
“Surely it isn’t best practice to have work like this going on so close to pedestrians?”
The public realm works began again during the second week in January with the contractor, McLaughlin & Harvey, advising businesses on streets affected by the latest works during late December.
With regard to the incident involving the flying piece of debris, a council spokesperson said: “In terms of health and safety, the contractor is working within all legislative requirements and will aim to meet or exceed best practice.”

Renville County deputies were called to the Southern Minnesota Beet Sugar Cooperative, located approximately two miles east of the City of Renville, shortly before 3 p.m.
Once on the scene first responders found a 60 year old male who had been run over by a payloader. Visibility was poor at the time of the accident due to wind blowing beet pulp around the plant.

Seven men were injured and a perfume factory gutted in two separate fires here on Thursday, rescue officials said.
In the first incident, a fire engulfed a three-story building near Khursheed Cinema in Raja Bazaar containing a perfume factory and its showroom.
The early-morning fire caused problems for the fire fighters, as the old building contained a lot of wood and had just one entry and exit point, said a rescuer.
It took about an hour to get the fire under control. The factory, Jamil Hair Oils and Perfumes, was completely burnt. In the second incident seven people received minor injuries after a fire broke out on the ground floor of their house at Sanghar Town near Koral Chowk.
